What legal recourse do I have and where can I file a complaint about this?
I just purchased a used vehicle from a dealership. During our negotiations we agreed on a price of 16500 and a payment of $329 a month for a 72 month term. When we got into the finance office, of course, they sold us on the GAP and extended warranty, which I had planned on getting anyway and figured into the budget for the payment. We agreed on the payment amount and he printed up the contract. As we reviewed the contract I noticed that on the sales price of the vehicle they had put 19980 instead of the 16500 that we agreed on. So I questioned him, to which he quickly and confidently replied, that includes all the taxes fees and insurances. I accepted his answer but as I read on noticed that those amounts were added on after that price which brought the total to over 21700. As he “researched” the issue on his computer I noticed on one of the pages an amount of about 2700 attributed to a “protection pkg”. Plz read second post.
You have been bait-and-switched..it’s a common ploy of car dealers…keep selling, selling, selling.
Heres’ what you do…RESCIND YOUR PURCHASE, based on fraud.
Have an attorney act as a settlement agent, where they bring in certifed funds of everything you’ve paid, and when they do, you bring in the car and hand them the keys…but they have to also cancel all of your contracts and the loan and insurance and all the other gizmo’s they up-sold you on.
Don’t think they won’t give up without a fight…they’re trained to badger you until YOU give in….well thats a two way street, so also call your state consumer protection agency and the FTC and file complaints, and attach the complaint numbers to your rescission. You can go online and look up your states rescission laws under consumer protection and remedies for the form it should take…send it certified mail return receipt requested…put on the receipt you get from the post office NOTICE OF RESCISSION.
If they give you ANY guff, sue them for Unfair and Deceptive Trade Practices, Fraud, and treble damages..that means you TRIPLE everything you have already paid, ….plus ask for an additional $25,000.00 in punitive and exemplary damges for their fraudulent business practices..plus your legal costs and attorney fees….their insurance will have to defend them and their rates will go up…keep on them and they’ll settle with you..guaranteed.
Of course if you really WANT the vehicle, accept their offer to bring the sales price down to the $16,500 plus have them throw in a few things for your inconvenience…but DON’T dismiss your government complaints..its ILLEGAL for them to ask you to do that….let the govt take care of them.
